Article 1 — Parties

This contract is made between the owner (lessor) — Gîte Belle Vue, [TO BE COMPLETED] (full legal name, address, and SIRET registration number if applicable) — and the lead guest, identified at booking (name, email, phone). The lead guest must be over 18, books on behalf of all occupants and guarantees their observance of this contract.

Article 2 — Subject & the property

A furnished seasonal rental (holiday accommodation, excluding any principal residence; not exceeding 90 consecutive days for the same guest) of: Gîte Belle Vue, Olargues (Haut-Languedoc, Hérault, Occitanie), France. Entire villa — 3 bedrooms, sleeping up to 9 guests (4 included in the standard price). Amenities include a heated pool, optional private hot tub, equipped kitchen, covered terrace and on-site parking. A description and inventory (condition report) is provided no later than on arrival.

Article 3 — Length of stay

On the dates stated in the booking confirmation. Arrival from 16:00, departure before 10:00 (free late check-out on request, subject to availability). The property is let for holiday-residential use only; sub-letting and exceeding the capacity (9) are not permitted without prior written agreement.

Article 4 — Price & breakdown

  • Rent: the per-night rate shown at booking.
  • Additional guests: €30 per person, per night beyond 4 (up to 9; children count, under-2s do not).
  • Options chosen at booking: hot tub/jacuzzi €75 per stay; pet €30 (max 2, on request).
  • Bed linen and towels provided. End-of-stay cleaning: (draft — to confirm) (included, save for excessive cleaning charged in addition).
  • Tourist tax (taxe de séjour): charged in addition, collected on behalf of the Communauté de communes du Minervois au Caroux. Rate set by the authority (per person per night; under-18s are exempt). Exact amount [TO BE COMPLETED] — schedule published at ccminervoiscaroux.taxesejour.fr.

The booking page shows the full itemised total before payment and prevails on amounts.

Article 5 — Payment terms (arrhes)

A 50% payment is due at booking as arrhes (draft — to confirm); the balance is due 6 weeks before arrival (a secure payment link is sent beforehand). If the booking is made within 6 weeks of arrival, the full amount is due at booking. Payment by card via Stripe. Legal nature: absent a contrary statement, sums paid are arrhes (art. 1590 of the Code civil) — see Article 7. The arrhes/acompte classification will be confirmed at legal review.

Article 6 — Security deposit

A security deposit may be taken on arrival (cash or card pre-authorisation), of an indicative order of 20–30% of the rental (draft — to confirm) (exact amount [TO BE COMPLETED]). It is returned, less the cost of any damage or losses found at the departure condition report, within 7 to 14 days (draft — to confirm) after departure.

Article 7 — Cancellation & withdrawal

As the sums paid are arrhes (draft — to confirm): if the guest cancels, the arrhes are retained by the owner; if the owner cancels, the owner returns double the arrhes to the guest (art. 1590 of the Code civil). Accommodation services for a fixed date are not subject to the 14-day right of withdrawal (art. L221-28, 12° of the Code de la consommation). Cancellation insurance is recommended. A graduated cancellation scale may be added after legal review: [TO BE COMPLETED].

Article 8 — Condition report & inventory

A condition report and inventory are made on arrival and departure. Any reservation about the state or equipment of the property must be reported within 24 hours of arrival; failing which the property is deemed compliant.

Article 9 — Guest obligations & house rules

The guest enjoys the property peacefully and responsibly, and observes the House Rules — which form an integral part of this contract (quiet hours, pool & spa safety, no smoking, pets on request, etc.). No commercial activity, party or unauthorised event is permitted.

Article 10 — Insurance & liability

The lead guest is responsible for the whole party and for any damage to the property and its contents. They confirm they hold personal liability / holiday (villégiature) insurance for the stay, and will evidence it on request.

Article 11 — Personal data (GDPR)

The data provided (identity, contact details, occupants’ names) is used only to manage the booking and meet legal obligations (host register, tourist tax). It is not sold or shared with third parties for marketing, and is kept only as long as necessary. The guest has rights of access, rectification and erasure.

Article 12 — Disputes, mediation & governing law

This contract is governed by French law. In the event of a dispute the parties will seek an amicable solution; a consumer may use a consumer mediator free of charge ([TO BE COMPLETED] — mediator to be designated). Failing agreement, the dispute falls under the competent courts in France. In case of conflict, the particular terms of the booking confirmation prevail over these general terms.
